আপনি যদি চুক্তির সাথে একমত না হন (বা মেনে চলতে না পারেন) তবে আপনি পরিষেবাটি ব্যবহার নাও করতে পারেন, তবে দয়া করে digitalalfalah@gmail.com এ ইমেল করে আমাদের জানান যাতে আমরা একটি সমাধান খুঁজে বের করার চেষ্টা করব। এই শর্তাবলী সমস্ত দর্শক, ব্যবহারকারী এবং অন্যদের জন্য প্রযোজ্য যারা পরিষেবা ব্যবহার করতে ইচ্ছুক।

গোপনীয়তাঃ

চুক্তির সময় অনুগ্রহ করে আমাদের গোপনীয়তা নীতি পর্যালোচনা করুন । আমাদের দ্বারা প্রদত্ত কোম্পানির তথ্য/ডেটা সম্পূর্ণ গোপনীয় রাখতে হবে। আপনি বা আপনার সাইটের ব্যবহার আমাদের দ্বারা কঠোরভাবে গোপনীয়তা বজায় রাখা হবে। গোপনীয়তা চুক্তি এবং প্রযোজ্য আইন ও প্রবিধান অনুযায়ী আপনি যদি গোপনীয়তা চুক্তিতে উল্লেখিত পদ্ধতিতে স্থানান্তরিত বা সঠিক ব্যবহার করা না হয়, সেই ক্ষেত্রে আমরা প্রয়োজনীয় পদক্ষেপ গ্রহণ করতে পারি।

• মেমোরেন্ডাম অফ অ্যাসোসিয়েশন এবং আর্টিক্যাল অফ অ্যাসোসিয়েশন
• শেয়ারহোল্ডারদের বিশেষ বিবরণ (শেয়ারহোল্ডার একজন বাংলাদেশী হলে জাতীয় পরিচয়পত্র )
• পরিচালকদের বিবরণ (ট্যাক্স আইডেন্টিফিকেশন নম্বর সহ)
• নিবন্ধিত ঠিকানা
• স্বাক্ষরিত ফরম lX এবং সাবস্ক্রাইবার পৃষ্ঠা।

বৌদ্ধিক সম্পত্তির অধিকারঃ

আমাদের পরিষেবাগুলির সাথে সংযুক্ত সমস্ত উপাদানের, যেমন সফটওয়্যার, কোড, ডিজাইন, টেক্সট, চিত্র, এবং গ্রাফিক্সের বৌদ্ধিক সম্পত্তির অধিকার আল-ফালাহ ডিজিটাল সার্ভিসেসের মালিকানা অধিকারী বা লাইসেন্স প্রাপ্ত। এই উপাদানগুলির অননুমোদিত ব্যবহার নিষিদ্ধ।

পরিষেবার ব্যবহারঃ

আমাদের পরিষেবাগুলি ওয়েব এবং মোবাইল অ্যাপ্লিকেশনের সৃষ্টি ও ডেভেলপমেন্টের জন্য প্রদান করা হয়, যা ক্লায়েন্টের সাথে সম্মত হয়। আপনি কোনও অবৈধ বা অননুমোদিত উদ্দেশ্যে আমাদের পরিষেবাগুলি ব্যবহার করতে পারবেন না।

ক্লায়েন্টের দায়িত্বঃ

আল-ফালাহ ডিজিটাল সার্ভিসেস এর একজন ক্লায়েন্ট হিসেবে আপনি সম্মত হন যে আপনি সম্মত স্পেসিফিকেশন এবং টাইমলাইন অনুযায়ী পরিষেবা সম্পূর্ণ করতে প্রয়োজনীয় সমস্ত তথ্য, উপাদান এবং অনুমোদন প্রদান করবেন।

প্রোডাক্ট ডেলিভারির সময়সীমাঃ

আল-ফালাহ ডিজিটাল সার্ভিসেস সম্মত সময় সীমার মধ্যে উচ্চ মানের পরিষেবা প্রদানে বদ্ধপরিকর। আমাদের সফ্টওয়্যার বা পরিষেবা ব্যবহার বা ক্রয়ের পূর্বে ক্লায়েন্টের সাথে চুক্তিপত্র স্বাক্ষর করে নেয়া হয় এবং প্রেরিত TOR (Terms Of Requirements / প্রয়োজনীয় শর্তাবলী) অনুসারে আমরা আমাদের সার্ভিস দিয়ে থাকি। তবে, ডেলিভারির সময়সীমা ক্লায়েন্টের চাহিদা অনুযায়ী পরিবর্তন হতে পারে।

পণ্য ফেরতঃ

আমাদের মধ্যকার চুক্তির শর্তাবলীতে সম্মত না হন তবে আপনি আমাদের সার্ভিস বা সফ্টওয়্যারটি  ব্যবহার নাও করতে পারেন এবং আপনি আল-ফালাহ ডিজিটাল সার্ভিসেস-এর সাথে যোগাযোগ করে সিস্টেম ক্রয়ের মূল্য ফেরতের জন্য অবিলম্বে পণ্যটি ফেরত দিতে হতে পারে। চুক্তিপত্র অনুসারে নিয়ম নীতি মেনে সার্ভিস ফেরত যোগ্য।

বিক্রয় পরবর্তী সেবাঃ

TOR (Terms Of Requirements / প্রয়োজনীয় শর্তাবলী) এ উল্লেখিত থাকলে অথবা পরবর্তী বিবেচনা অনুসারে আমরা আমাদের সার্ভিস অথবা প্রোডাক্ট হস্তান্তরের পর চুক্তিপত্র অনুসারে পরিপূর্ণ সাপোর্ট দিয়ে থাকি।

মূল্য ফেরতঃ

আমাদের মধ্যকার চুক্তির শর্তাবলীতে সম্মত না হন তবে আপনি আমাদের সার্ভিস বা সফ্টওয়্যারটি ব্যবহার নাও করতে পারেন এবং আপনি আল-ফালাহ ডিজিটাল সার্ভিসেস এর সাথে যোগাযোগ করে সিস্টেম ক্রয়ের মূল্য ফেরতের জন্য অবিলম্বে পণ্যটি ফেরত দিতে হতে পারে। চুক্তি পত্র অনুসারে নিয়ম নীতি মেনে মূল্য ফেরত যোগ্য হতে পারে।

পেমেন্টের শর্তাবলীঃ

পেমেন্টের শর্তাবলী ক্লায়েন্টের সাথে আলাদা চুক্তি বা পরিষেবা চুক্তিতে নির্দিষ্ট করা হবে। সমস্ত ফি সম্মত হিসেবে প্রদান করতে হবে।

ক্ষতিপূরণঃ

ক্লায়েন্টরা সম্মত হন যে আমাদের পরিষেবাগুলির ব্যবহার থেকে উত্থাপিত কোনও দাবি, ক্ষতি, বা খরচের জন্য আল-ফালাহ ডিজিটাল সার্ভিসেসকে ক্ষতিপূরণ দেবেন এবং হানিকর থেকে মুক্তি দেবেন।

শর্তাবলীর পরিবর্তনঃ

আল-ফালাহ ডিজিটাল সার্ভিসেস যে কোনও সময় এই শর্তাবলীতে পরিবর্তন করার অধিকার সংরক্ষণ করে। এই ধর্নের পরিবর্তনের পর আপনার আমাদের পরিষেবাগুলি অব্যাহত রাখার মাধ্যমে নতুন শর্তাবলী মান্য করার মানে।

প্রচলিত আইনঃ

এই শর্তাবলীগুলি আল-ফালাহ ডিজিটাল সার্ভিসেস যে দেশ/রাষ্ট্রে পরিচালনা করে সেই আইনের দ্বারা নিয়ন্ত্রিত, তার আইনের দ্বন্দ্ব বিধানগুলির বিবেচনা ছাড়া।

Please review our Privacy Policy during the agreement process. Company information/data provided by us must be kept strictly confidential. Your use of our site will be maintained with strict confidentiality by us. We may take necessary action if the information is not transferred or used correctly in the manner specified in the privacy agreement and in accordance with applicable laws and regulations.

• Signed Form IX and Subscriber Page.

Intellectual Property Rights: 

Al-Falah Digital Services owns or is the licensee of the intellectual property rights for all materials connected with our services, such as software, code, designs, text, images, and graphics. Unauthorized use of these materials is prohibited.

Use of Services: 

Our services are provided for the creation and development of web and mobile applications, as agreed with the client. You may not use our services for any illegal or unauthorized purpose.

Client’s Responsibilities: 

As a client of Al-Falah Digital Services, you agree to provide all necessary information, materials, and approvals required to complete the service according to the agreed-upon specifications and timeline.

Product Delivery Timeline: 

Al-Falah Digital Services is committed to providing high-quality services within the agreed-upon timeframe. A contract is signed with the client before the use or purchase of our software or service, and we provide our services according to the submitted TOR (Terms of Requirements). However, delivery timelines may vary based on the client’s needs.

Product Return: 

If you do not agree to the terms of our contract, you may not use our service or software, and you may be required to return the product immediately by contacting Al-Falah Digital Services for a refund of the system purchase price. The service is returnable according to the rules and policies stipulated in the contract.

After-Sales Service: 

We provide full support for our service or product after handover as per the contract, if mentioned in the TOR (Terms of Requirements) or based on subsequent considerations.

Refund: 

If you do not agree to the terms of our contract, you may not use our service or software, and you may be required to return the product immediately by contacting Al-Falah Digital Services for a refund of the system purchase price. Refunds may be applicable according to the rules and policies of the contract.

Payment Terms: 

Payment terms will be specified in a separate agreement or service contract with the client. All fees must be paid as agreed.

Indemnification: 

Clients agree to indemnify and hold harmless Al-Falah Digital Services from any claims, damages, or expenses arising from the use of our services.

Changes to Terms: 

Al-Falah Digital Services reserves the right to change these Terms at any time. Your continued use of our services after such changes signifies your acceptance of the new terms.

Governing Law: 

These Terms shall be governed by the laws of the country/state in which Al-Falah Digital Services operates, without regard to its conflict of law provisions.
